    Doesn’t the presence of a third-party usually negate an expectation of privacy? I understand the urge to ban such unacceptable behavior, but what does it mean for for instance, surispeciously recording a person who is making threats in your home? Wouldnt they have a similar expectation of privacy? I’m afraid there is a “sex is special” argument which is doing a lot of the heavy lifting.
