Kennedy was the star of the first slew of opinion announcements. Roberts 20min. announcement did not seem to address the Court’s power to take the case under the Anti-Injunction Act. Kennedy’s “judicial legislation” approach would probably have sound more convincing coming out of Scalia’s mouth; Scalia after all was the most senior of the joint dissent.
