    Thanks for a very nice post, and mentioning Jim and my article in the New England Journal. I think I might just slightly disagree with your characterization of the New England Journal Article as a “defense” of the coercion argument — the main purpose was just to explain the argument and the cert grant to non-law audiences. Indeed, as I mentioned over at Prawfsblawg and in our public event on the subject http://www.law.harvard.edu/media/2011/10/27_pf.mov, I think even the two authors of the article have very different views as to its likelihood to succeed. One more reason the piece was largely descriptive of the arguments likely to be raised and the case law rather than evaluative….
