    Interestingly, Scalia signed on to a very similar passage from Justice Kennedy in Frew v. Hawkins back in 2004 (see part III of the opinion):

    The State of California has had well more than two years to ensure they built the proper amount of prisons to humanely lock up their criminals. The court system can’t be faulted for California’s inadequacies.
