    Isn’t argument 2 an argument for changing the standards causing problems in 2? You might connect that to a record-keeping proposal, perhaps by insisting on a Title II to the Act dealing with expedited nonparty subpoenas on ISPs (e.g., Virginia’s statute on John Doe subpoenas), but I don’t see how it’s a strong argument against a record-keeping requirement per se.
