Admittedly, this sympathy is motivated less by an urge to protect racists and the similar sorts of pond scum that like to spew poison on AutoAdmit, and more by an urge to protect corporate whistleblowers, political dissidents, file-sharers (yah, yah), people who publish &quot;copyrighted&quot; church of scientology documents, etc. etc.  But still, I wouldn&#039;t &quot;cut down all the laws in England&quot; just to get a guy like Ciolli.

So, were this firm&#039;s action motivated by a desire to punish, to enforce social norms, I&#039;d be a little trepid.  The people who really ought to be punished are the people who did the stalking, who posted the bile, etc.  And while Ciolli might be the only person (save his co-management at that site) who can provide the information necessary to get at the real wrongdoers, it&#039;s unlikely in the extreme that his choices along that line would, or could, affect the firm&#039;s decision.

Because really, the firm&#039;s decision wasn&#039;t punishment.  The firm&#039;s decision was simply an economically rational way of protecting its own reputation.  No law firm wants to be known as the place that hired the guy who ran the hate board.  And that&#039;s a kind of consequence that isn&#039;t punishment, and is totally predictable and reasonable.  No firm should be asked to take that kind of bullet just to avoid taking a position on whether it&#039;s an &quot;enforcer of values.&quot;

So the phrase &quot;distribution of justice&quot; isn&#039;t really appropriate.  Ciolli just failed to take into account the reputational costs of his behavior for future employers.  By running his board, he made himself less qualified for jobs requiring a good reputation.  So, as the late Kurt Vonnegut would say, it goes.

As someone who used to post on XO (I haven’t in a long time), I do think he’s getting an unfair shake here.  Here’s why:

Come on, it’s manslaughter.  Are we really going to argue what Ciolli did was worse?

Concerning the merits of the case, Ciolli defamed the students by allowing the thread to stay up.  He should have taken it down when they asked him to.  There’s a decent chance he’ll lose in court.  At the same time, if the students are angry they didn’t get a 1L summer job at the firm, someone ought to explain to them there’s a possibility they didn’t get a 1L summer job for same the reason most students, even at top schools don’t get a 1L firm summer job.  It’s your first year of law school.  I realize they went to Yale, (and, again I do think Ciolli’s actions were wrong; I also actually do think they have a case) but if your instinct is to sue somebody when you don’t get a job during your first year, welcome to planet Earth.  Get ready for a few more disappointments along your legal career.

I liked the XO board when I posted for two reasons:

1.) during my time in law school it was, by far, the best place to get a political debate going.  My school was monolithic politically.  It would have been damn near impossible in class or even outside of it to debate the stuff that I did on the board (yes - there were serious debates there, not just the more infamous threads).

2.) It also was a replacement for the Greedy Associates board, which by the time I entered law school was pretty dead.  XO was a good place to find out about information on other schools and firms and to get advice that, as annoying as it might have been, was also a lot more frank than I would have gotten anywhere else.

I’ll say this about the racial/anti-Semitic threads.  I do think that’s an unfair slam.  A lot of times people would post one thread that had one post that said something along those lines . . . and that was it.  It’d fall off the page.  If we were engaging in a serious debate and someone actually tried to argue that stuff, they were nailed to the wall.  A person getting on a thread about Israel and deciding argue some anti-Semetic aspects was a person who within five minutes was going to get ripped limb from limb by the other posters.

In the few times I looked at AutoAdmit I didn&#039;t see anything about firebombing resturants (as opposed to raping women, for example) so I guess that is a good mark on their side, as far as not calling for fire bombing resturants can count as good.  I don&#039;t regularly read feministe, either, but the times I have I also didn&#039;t see anything about fire bombing resturants, or assulting people, or rampant vile hate.  Maybe there are some bad things there.  As I say, I don&#039;t regularly read it.  But my more or less random times going to the two places has been quite different.
